Sometimes, if an opponent is wholly unreasonable, Court litigation becomes the only way to resolve a dispute.

The cost of Court proceedings means that overall someone is likely to lose out. We advocate the use of alternative ways to reach a fair and principled agreement to end a dispute. Cases often settle at the door of the Court, sometimes because it is the first time that parties talk, listen and understand each other’s position. If only this could be achieved sooner, the expense can be saved and goodwill need not be lost.

This is what alternative dispute resolution aims to do. It is voluntary, but increasingly the Courts expect you to have tried to settle the case by such means before, or at an early stage of the proceedings.
