ArbitrationArbitration is a more formal type of Alternative Dispute Resolution (ADR) compared with Mediation. It is a way to have a final decision reached without going to Court. An Arbitrator is given the job of reaching a formal decision on the dispute. The arbitrator is independent. Someone with expertise in the subject matter of the dispute can be appointed and this is often better than having a judge who may hear any kind of case. The process can be agreed between the parties and the arbitrator. It can be summary and informal or detailed and formal. The arbitrator will usually hold a hearing, and will then come to a decision. The decision is binding on both parties. The hearing is in private, and it can be agreed that the outcome will not be published. Arbitration can be faster than litigation, and expense can be saved, but the parties must have agreed to go to arbitration. If one party will not agree to go to arbitration or any other form of alternative dispute resolution, the alternative is litigation at Court. We offer a
