Charities and Charity Law

Our lawyers advise on
setting up and administering charities

Family Charities

Setting up a family charity trust has many tax advantages, but would also allow you to make worthwhile donations to charitable causes, creating a lasting legacy in your family’s name.

If properly drafted, charitable trusts can provide you with a level of control over the type of charity which will receive money, whilst allowing you to benefit from relief from a variety of taxes including Inheritance Tax and Capital Gains Tax.

For example, you could establish a trust using shares which would ordinarily attract a large Capital Gains Tax liability. You would not have to personally pay any Capital Gains on the transfer to the charity and neither would the charity itself.

Although trustees are expected to distribute the bulk of the income from the trust, if the fund is invested wisely the capital will grow, with the income accruing tax free.
