MediationA form of Alternative Dispute Resolution - ADRAmbrose Appelbe offer a Mediation Service to businesses and individuals who face any kind of commercial or personal dispute. Mediation is relevant to disputes of all kinds - matrimonial and divorce disputes, trusts, employment, professional negligence and property-related disputes such as those between landlord and tenant are all capable of being resolved by mediation. Ongoing disputes are draining on resources. Litigation can be costly
and time-consuming. Our aim is to resolve disputes quickly and cost
effectively by the best means possible.
The Gibbons Report encourages Alternative Dispute Resolution - more
mediation is required. There are parallels between Family Law and
Employment Law if unfair dismissal and irretrievable breakdown are
compared. Following the repeal of the Statutory procedures ACAS is
supposed to be a conduct to Advance Dispute Resolution and
Pre-conciliatory Conciliation. We advocate the use of alternative ways to reach a fair and principled agreement to end a dispute. Cases brought to litigation often settle at the door of the Court, sometimes because it is the first time that parties talk, listen and understand each other’s position. If this could be achieved sooner, the expense can be saved and goodwill need not be lost. Lisa Bolgar Smith is a trained family mediator. Alternative Dispute Resolution is voluntary, but increasingly the Courts expect you to have tried to settle the case by ADR before, or at an early stage of, the proceedings. At Ambrose Appelbe we advise upon and arrange formal ADR. Our track record is excellent and all cases have settled sensibly, some within days, at a cost far less in terms of money and emotion than through the Courts. We strongly favour Mediation and have developed a Mediation Service which offers a structured and flexible framework within which parties stand a very good chance of resolving their differences quickly and economically. Mediation offers a sensible middle course. Even less formality is involved in Round Table Meetings. Sometimes, formal Arbitration or Court Litigation becomes the only way to resolve a dispute.
