Mediation Service

Mediation is an advanced form of round table meeting. As well as the parties, and the legal representatives, a neutral mediator is present.

The mediator’s job is to try to assist the resolution of the dispute by acting as a go-between. The mediator ensures that both parties understand each other's positions. The mediator can put proposals, or can confirm whether proposals would be acceptable. Sometimes the mediator will propose solutions that neither party had considered. The process is voluntary - no one is bound to accept a solution proposed by a mediator.

Either party can suggest creative solutions which a court would be unable to put forward and that litigation certainly would not bring out. Most cases are settled in a day at a fraction of the cost of going to court.

If set up correctly, with a good mediator, mediation can be highly effective.

With Mediation, the parties can sit round the table with their advisers and, with the help of the neutral mediator, resolve the dispute.
 
Alternatively, the parties need not meet their "adversary" face to face, thus saving embarrassment and enabling complete confidentiality to be preserved.

 

Before embarking on Mediation, the parties should ask themselves some questions:

Are you considering legal action to resolve a dispute?
 
What is your risk of losing litigation?
 
Are you prepared to settle instead of litigating?
 
Is speed important to you?
 
Do you want to meet the other side face-to-face?
 
Do you want to preserve your commercial relationship?
