Mediation |
Mediation Service Mediation is an advanced form of round table meeting. As well as the parties, and the legal representatives, a neutral mediator is present. The mediators job is to try to assist the resolution of the dispute by acting as a go-between. The mediator ensures that both parties understand each other's positions. The mediator can put proposals, or can confirm whether proposals would be acceptable. Sometimes the mediator will propose solutions that neither party had considered. The process is voluntary - no one is bound to accept a solution proposed by a mediator. Either party can suggest creative solutions which a court would be unable to put forward and that litigation certainly would not bring out. Most cases are settled in a day at a fraction of the cost of going to court. If set up correctly, with a good mediator, mediation can be highly effective.
