H v An Insurer acting for claimant (pre-issue) in call on home insurance policy following burglary. Cover declined for certain specific high value items on grounds of alleged breach of Safe Warranty. Upper limit of cover for unspecified valuables also in dispute. Further allegations made by insurer of misreporting by insured.
R v An Insurer acting for claimant (pre-issue) in a challenge to a declinature of coverage under an indemnity insurance policy where claims of over £10m existed. Central issue was construction of clauses relating to exclusion for dishonest acts.
Y v JF (C) Ltd acting for claimant against Insurance broker in respect of misappropriation of insurance premiums. Subsequent successful claims to the FSCS (Financial Services Compensation Scheme) and additional enforcement by way of Third Party Debt Order, granted on submissions at Court against both client and office accounts of FSA registered broker.
