Making a Will

Making a Will is the best way to ensure that your property and personal belongings are distributed amongst your family, friends and / or chosen charities in accordance with your wishes after your death. Although there is no legal requirement for you to make a Will, it is always better to do so, because if you die intestate (i.e. without a valid Will) your assets will be distributed according to the Intestacy Rules, rather than in accordance with your wishes. This means that without a Will you lose control over what happens to your belongings on your death and there is no way of ensuring that your wishes are followed. It can also make the administration of your estate unnecessarily complex and stressful for those you leave behind. It is particularly important to make a Will if:

  • you have children
  • you own a property
  • you are cohabiting with someone
  • you get married or enter into a Civil Partnership
  • you get divorced or dissolve your Civil Partnership
  • your financial circumstances change
  • you are considering tax planning
