Recent work

A & A v A acting for claimants (in lengthy pre-issue negotiations) in claim for sale proceeds due under post-death sale of consortium owned Estate properties and further sums due with an attributed financial value of c. £3m. Included issues of Deputyship and Mental Capacity, pre-action disclosure, Intestacy and Administration of Estate.

M v Executors of M successfully defended executrix against 13 separate allegations of breach of trust, breach of duty towards beneficiaries and false or negligent accounting, with an attributed financial value of more than £300k. Thereafter, successful costs claim at SCCO against Legal Services Commission for full costs.

Executor of T v Executor of T acting for professional executrix against co-executrix in claim for unauthorised use of deceased’s credit cards before and after date of death, failing to account to the Estate for rental income obtained from deceased’s property after date of death, misappropriation of encashed accounts and further debit card payments, with additional claim for professional fee damages. Enforcement by Writ of FiFa. Also included issues of notice to determine licence of occupation of property and invalidation of purported lease agreement as well as proposed application for removal of executrix.
